9. GENERAL PROVISIONS

9.1. The BUYER acknowledges that, before entering into this Agreement, the BUYER has reviewed the essential characteristics of the products, the price including taxes, payment method, delivery information and the SELLER’s contact information on the Site and has provided the required electronic confirmation.

9.2. Each product will be delivered to the BUYER or to the person or organization at the address designated by the BUYER within the period stated in the pre-contractual information on the Site and, in any event, within the maximum period required by applicable law. If delivery is not completed within the applicable period, the BUYER retains the rights provided by law.

9.3. The SELLER will provide the product complete, in accordance with the order specifications and, where applicable, together with required warranty documents, instructions and other documents, and will perform its obligations with due care and in accordance with applicable law.

9.4. Before the performance obligation expires, the SELLER may provide a different product of equivalent quality and price only after informing the BUYER and obtaining the BUYER’s express consent.

9.5. If fulfillment of the ordered product or service becomes impossible, the SELLER will notify the Consumer in writing within the period required by applicable law and refund the amount due within the applicable statutory period.

9.6. Delivery is subject to the BUYER’s electronic confirmation of this Agreement. If the product price is not paid or the payment is canceled in bank records, the SELLER’s obligation to deliver the product ends.

9.7. If, after delivery, the BUYER’s credit card is used unlawfully by an unauthorized third party and the relevant bank or financial institution does not pay the product price to the SELLER, the BUYER will return the product to the SELLER in accordance with applicable law. Where the Turkish source agreement provides for return shipping in this circumstance to be borne by the SELLER, that provision applies.

9.8. If the SELLER cannot deliver the product on time because of force majeure or circumstances beyond the reasonable control of the PARTIES, the SELLER will inform the BUYER. The BUYER may exercise the rights available under applicable law, including cancellation where applicable. Any refund due following cancellation will be made within the statutory period. The time required for a card refund to appear in the BUYER’s account may depend on the relevant bank’s processing times.

9.9. The SELLER may contact the BUYER using the contact details provided in connection with the order for transactional communications, notifications and other communications permitted by applicable law. Marketing communications are subject to any consent or other legal basis required by applicable law.

9.10. The BUYER should inspect the goods on delivery where reasonably possible and notify the SELLER of visible damage or defects. Nothing in this provision limits the BUYER’s mandatory consumer rights after delivery.

9.11. Where reasonably necessary to prevent fraud or unauthorized card use, the SELLER may request information or documentation required to verify the payment or cardholder, subject to applicable law and data protection requirements. The order may be placed on hold or canceled if the required verification cannot be completed.

9.12. The BUYER confirms that the information provided to the SELLER during the order and delivery process is accurate and up to date.

9.13. The BUYER must use the SELLER’s website in accordance with applicable law.

9.14. The BUYER may not use the Site for unlawful purposes or in a manner that disrupts its security or operation.

9.15. The Site may contain links to websites or content owned or operated by third parties outside the SELLER’s control. Such links are provided for convenience and do not constitute an endorsement or guarantee of third-party content.

10. RIGHT OF WITHDRAWAL

10.1. For distance contracts relating to the sale of goods, the BUYER may exercise the statutory right of withdrawal within 14 days from the date the product is delivered to the BUYER or to a person or organization designated by the BUYER, without giving any reason and without incurring a penalty, subject to the exceptions provided by applicable law. For services, the withdrawal period begins on the date the contract is concluded. Where performance of a service begins with the Consumer’s consent before the withdrawal period expires, the applicable statutory exceptions may apply. The BUYER acknowledges having been informed of the right of withdrawal.

10.2. To exercise the right of withdrawal, the BUYER must notify the SELLER within the 14-day period using a method permitted by applicable law, including email. Where the right of withdrawal is exercised:

a) any invoice or return documentation required under applicable tax rules should be provided where applicable,
b) the return form should be included where required,
c) the goods should be returned complete with their box, packaging and standard accessories where applicable,
d) the SELLER will refund the payments required by applicable law within 14 days of receiving the withdrawal notice. The BUYER must send the goods back to the SELLER or the carrier designated by the SELLER within 14 days of the withdrawal notice,
e) the BUYER may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, as provided by applicable law,
f) if exercising the right of withdrawal causes an order to fall below the threshold of a promotion, any discount granted under that promotion may be recalculated to the extent permitted by applicable law.

11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to goods or services excluded under the Turkish Distance Contracts Regulation and other applicable law. These may include, among others, goods made to the BUYER’s specifications or clearly personalized; goods liable to deteriorate rapidly or expire; sealed goods that are not suitable for return for health or hygiene reasons once unsealed; goods that become inseparably mixed with other items after delivery; certain periodicals; digital content or services supplied immediately in electronic form where the statutory conditions for loss of the right of withdrawal are met; and services whose performance has begun with the Consumer’s consent where the applicable statutory exception applies.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on obligations arising from a credit card transaction, the relationship between the BUYER and the card-issuing bank will be governed by the applicable credit card agreement and law. Any rights of the SELLER arising from a default will be determined in accordance with applicable law.

13. CONSUMER DISPUTES

Consumer disputes arising from this Agreement may be submitted to the competent Consumer Arbitration Committees or Consumer Courts in the Consumer’s place of residence or the place where the consumer transaction took place, subject to the jurisdictional and monetary thresholds in force under applicable Turkish law.

14. ENTRY INTO FORCE

By completing payment for an order placed through the Site, the BUYER confirms acceptance of this Agreement. The SELLER will ensure that the BUYER is given the opportunity to read and accept the Agreement before the order is completed.
